The Service is operated under the name PomuBots ("PomuBots", "we", "us", or "our").

PomuBots provides users with tools to create, personalize, and interact with AI-powered digital companions.

The Service may introduce new features, modify existing functionality, or discontinue certain parts of the platform as it continues to develop.

You must be at least 13 years old to create an account or use PomuBots.

By using the Service, you represent and warrant that:

• You are at least 13 years old.
• The information you provide during registration is accurate and up to date.
• You are legally permitted to use the Service under the laws applicable to you.
• Your use of PomuBots does not violate any applicable law or regulation.

If you are between 13 and 17 years old, you may use PomuBots subject to these Terms and any additional parental consent or legal requirements applicable in your jurisdiction.

PomuBots does not knowingly permit individuals under the age of 13 to access or use the Service.

If we discover or reasonably determine that an account belongs to an individual under the age of 13, we will permanently terminate the account and initiate deletion of the account and its associated personal information across our systems, subject to applicable legal requirements.

Information that we are legally required or permitted to retain will be restricted and retained only for the period and purposes required by applicable law.

We reserve the right to introduce additional age-verification measures or restrict certain features based on a user's age, location, or applicable legal requirements.

Certain features of PomuBots require an account.

You agree to:

• Provide accurate registration information.
• Keep your login credentials confidential.
• Maintain the security of your account.
• Notify us promptly if you suspect unauthorized access.
• Accept responsibility for activities conducted through your account, except where applicable law provides otherwise.

You must not impersonate another person, create accounts using misleading information, or attempt to gain unauthorized access to another user's account.

We reserve the right to suspend or restrict accounts involved in fraudulent, abusive, or unauthorized activities.

PomuBots allows users to create and personalize AI-powered digital companions ("PomuBots").

Users may customize elements such as:

• Names and descriptions.
• Personality characteristics.
• Communication styles.
• Behavioral preferences.
• Other available personalization settings.

PomuBots are artificial intelligence systems. They are not human beings and should not be understood as conscious individuals or as entities with genuine human emotions, experiences, or personal relationships.

AI-generated responses are produced through automated systems and may occasionally be inaccurate, incomplete, misleading, or inappropriate.

You acknowledge and agree that:

• AI companions may generate unexpected responses.
• AI-generated information should be independently evaluated.
• We do not guarantee that every response will be accurate or suitable for every situation.
• AI companions are not substitutes for qualified professionals, including medical, legal, financial, or mental health professionals.

PomuBots may modify, restrict, or disable AI features when reasonably necessary to maintain safety, reliability, or legal compliance.

Safety is a fundamental part of the PomuBots experience.

PomuBots is designed to prevent its AI companions from assisting with illegal, harmful, abusive, or otherwise prohibited activities.

You must not use PomuBots to request, generate, distribute, or facilitate content or assistance involving:

• Illegal activities or violations of applicable laws.
• Violence, abuse, exploitation, or intentional harm.
• Self-harm or encouragement of harmful behavior.
• Sexual exploitation or inappropriate sexual content involving minors.
• Harassment, threats, intimidation, or targeted abuse.
• Fraud, scams, identity theft, or deceptive practices.
• Unauthorized access to systems, accounts, or private information.
• Malware, malicious activity, or other harmful technical misuse.
• Any other activity prohibited by applicable law or our policies.

You must not attempt to bypass, manipulate, disable, or interfere with PomuBots' safety systems, moderation mechanisms, or technical restrictions.

PomuBots may refuse requests, restrict functionality, review reported content, or take other appropriate measures when activity appears to violate these Terms.

Although we continuously work to improve our safety systems, we cannot guarantee that every AI-generated response will always be free from errors or policy violations.

You may submit content to PomuBots, including messages, prompts, descriptions, images, and personalization settings ("User Content").

You retain ownership of the rights you hold in your User Content.

By submitting User Content, you grant PomuBots a limited, non-exclusive, worldwide license to host, store, reproduce, process, and use that content only as reasonably necessary to:

• Provide and operate the Service.
• Generate AI responses and personalized experiences.
• Maintain account functionality.
• Protect the security and integrity of the Service.
• Enforce these Terms.
• Comply with applicable legal obligations.

This license is limited to the purposes described above and does not transfer ownership of your User Content to PomuBots.

You represent that you have the necessary rights and permissions to submit any content you provide.

You must not upload or submit content that infringes another person's intellectual property, privacy, or other legal rights.

Responses, text, and other materials generated by PomuBots' AI systems ("AI-Generated Content") may be provided to you as part of the Service.

To the extent permitted by applicable law, PomuBots does not claim ownership of AI-Generated Content solely because it was generated through the Service.

However:

• AI-generated content may not be unique.
• Similar or identical outputs may be generated for other users.
• AI-generated content may not qualify for intellectual property protection.
• You are responsible for evaluating how you use, reproduce, publish, or distribute AI-generated content.
• You must not use AI-generated content in a way that violates applicable laws or third-party rights.

Nothing in these Terms guarantees that any particular AI-generated output is eligible for copyright or other intellectual property protection.

You agree to use PomuBots responsibly and in accordance with these Terms.

You must not:

• Reverse engineer, decompile, or attempt to extract the source code or underlying models of the Service, except where such restrictions are prohibited by law.
• Interfere with the operation, security, or availability of PomuBots.
• Use automated methods to access the Service in an unauthorized manner.
• Exploit vulnerabilities or attempt to circumvent technical restrictions.
• Distribute spam, malicious software, or deceptive material through the Service.
• Misrepresent your identity or affiliation.
• Use the Service to violate another person's rights.
• Resell, sublicense, or commercially exploit the Service without our prior written authorization.

We may investigate suspected violations and take appropriate action.

PomuBots currently provides its available features without requiring a paid subscription.

We may introduce paid subscriptions, premium features, usage-based pricing, or other payment options in the future.

If paid features are introduced:

• Their prices and applicable conditions will be disclosed before purchase.
• Users will be required to agree to the relevant payment terms before being charged.
• Subscription duration, renewal conditions, cancellation procedures, and refund policies will be presented where applicable.
• Additional payment terms may supplement these Terms.

No user will be charged for a paid subscription or feature merely because such a feature is introduced. A purchase must be initiated or authorized through the applicable payment process.

Any mandatory consumer rights under applicable law remain unaffected.

PomuBots may rely on or integrate with third-party services, including AI providers, hosting infrastructure, analytics services, authentication providers, and payment processors.

These services may be subject to their own terms, privacy policies, and operational conditions.

We are not responsible for independent third-party services or their practices, except to the extent required by applicable law.

Your use of third-party services may be subject to additional terms imposed by their respective providers.

The PomuBots name, branding, logos, website design, software, interface, original materials, and other proprietary elements of the Service are owned by or licensed to PomuBots and are protected by applicable intellectual property laws.

Except where expressly permitted, you may not:

• Copy or reproduce substantial portions of the Service.
• Modify or distribute proprietary PomuBots materials.
• Use our branding without authorization.
• Claim ownership of our software, systems, or proprietary technology.
• Create unauthorized derivative products based on protected elements of the Service.

Nothing in these Terms transfers ownership of PomuBots' intellectual property to you.

Your use of PomuBots is also governed by our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, disclose, and protect personal information.

We may process information as necessary to operate the Service, maintain security, provide personalized functionality, and comply with applicable legal requirements.

We will handle personal information in accordance with our Privacy Policy and applicable data protection laws.

We aim to keep PomuBots available and functioning reliably. However, we do not guarantee uninterrupted or error-free operation.

We may:

• Update or modify features.
• Introduce new functionality.
• Temporarily suspend access for maintenance.
• Restrict certain functionality for security or legal reasons.
• Discontinue features where reasonably necessary.

We will make reasonable efforts to communicate significant changes when appropriate.

You may stop using PomuBots at any time.

We may suspend, restrict, or terminate your access if:

• You violate these Terms.
• You engage in fraudulent, abusive, or illegal activity.
• Your use presents a security or safety risk.
• We are required to do so by law.
• Continued access is no longer reasonably possible for operational or legal reasons.

Where appropriate, we may provide notice and an opportunity to address a violation before taking action.

Upon termination, your right to access the affected parts of the Service will end.

The handling and deletion of account information following termination will be governed by our Privacy Policy and applicable law.

PomuBots is provided on an "AS IS" and "AS AVAILABLE" basis to the maximum extent permitted by applicable law.

We make no guarantee that:

• The Service will always be available.
• AI-generated content will be accurate, complete, or reliable.
• Every feature will operate without interruption.
• The Service will meet every user's individual expectations.
• AI-generated content will be suitable for every intended use.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

To the maximum extent permitted by applicable law, PomuBots and its operators, affiliates, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Service.

This includes, where legally permissible, loss of profits, loss of data, business interruption, or damages arising from reliance on AI-generated content.

To the maximum extent permitted by applicable law, our total liability for claims arising out of or relating to the Service will be limited to the amount you paid to PomuBots for the Service during the twelve (12) months preceding the event giving rise to the claim.

If you have not made any payments to PomuBots, the limitation will apply to the extent permitted by applicable law.

Nothing in this section limits liability that cannot legally be limited or excluded.

To the extent permitted by applicable law, you agree to be responsible for claims, liabilities, damages, and reasonable expenses arising directly from your unlawful conduct, infringement of third-party rights, or material violation of these Terms.

This section does not require you to indemnify PomuBots for losses caused by our own unlawful conduct, negligence, or other liability that cannot legally be shifted to you.

We may update these Terms from time to time to reflect changes in our Service, business operations, legal obligations, or other relevant circumstances.

When material changes are made, we will take reasonable steps to notify users, such as publishing an updated version on our website or providing an in-product notification.

The updated Terms will identify their effective date.

Your continued use of PomuBots after updated Terms become effective constitutes acceptance of the revised Terms where such acceptance is legally valid.

If you do not agree with the revised Terms, you must stop using the Service.

These Terms will be governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, except where mandatory consumer protection laws require otherwise.

Any dispute arising out of or relating to these Terms or the Service will be brought before the competent courts of Delaware, subject to applicable jurisdictional requirements and mandatory legal protections.

Nothing in this section prevents consumers from exercising rights that cannot legally be waived or restricted.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

Our failure to enforce any provision does not constitute a waiver of that provision.

These Terms, together with the applicable policies referenced herein, constitute the agreement governing your use of PomuBots.

You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.
